You’ve come this far—now let’s wrap up our discussion by addressing the two things that can make or break an as-is home sale:
1. What you must disclose by law when selling as-is in Pennsylvania
2. Why it’s important to work with the right real estate agent (especially if you want an easy, low-stress experience)
(Here is where lots of people start to get nervous, though things don’t have to be complicated.) Let’s unpack it in human terms.
What the Law Actually Says
Selling your home as-is doesn’t mean you’re off the hook for disclosing problems. In Pennsylvania, you're legally obligated to complete a Seller’s Property Disclosure Statement (SPD). It’s a form in which you identify and explain anything you know that's wrong with the house — roof leaks, cracks in the foundation, water damage, problems with heating and plumbing and electricity and so forth. You’re not supposed to know everything, and you’re not required to chisel out walls or to hire inspectors. But if you see something that’s not right, you must report it.
The SPD shields the buyer, of course — but it also shields you. When everything’s put on the table early on, there’s less likelihood of disputes or legal trouble after closing. Being upfront now = peace of mind later.
And if your home was built before 1978, federal law requires you to complete a Lead-Based Paint Disclosure (LBP). Not to fear — all this paperwork is stuff that your agent can help you with. More on that below.
Why a Good Realtor Matters That Much
You’re selling as-is, but that doesn’t necessarily mean you should do this on your own. Indeed, the as-is approach only creates more questions when you don’t have the proper guide. Here’s how a good local agent can help:
- They’ll help you price it right: One of the trickiest parts of selling as-is is determining what the home is worth in its current state. A good agent will examine recent sales of similar homes in the area, both move-in ready and fixer-uppers, to arrive at a price that is realistic, competitive and fair to both sides.
- They’ll ensure you’re on firm legal ground: From the disclosure form to the agreement of sale, there’s plenty of fine print. Your agent will guide you through all of that and ensure all of it is done correctly. That way, you are following the law, and you don't get any bumps down the road.
- They’ll set expectations with buyers: Agents are masters at explaining what “as-is” really means to buyers and their buyers’ agents. That way, you’re not fielding repair requests after the inspection or being blindsided at the negotiating table with unrealistic demands.
- They’ll locate the buyers who’ll appreciate your home: Not all buyers are in the market for a “fixer upper”—but realities bear it out—some most definitely are. A great agent knows how to position your home for investors, flippers, and the handy buyer who’s hunting for a new project. That translates into more interest, more showings, and more likelihood of it getting done.
- They de-stress the whole thing: Possibly even more important than anything else — your agent is your shoulder to lean on. They schedule showings, monitor deadlines, respond to questions from the buyer’s side, and just give you those straight answers when you need those. When you’re selling a home — especially if it’s one you’ve lived in for years — emotions can get in the way.
